Duty & Mission of VIFCA
Objectives of VIFCA
To promote the development of arbitration and commercial mediation as methods of dispute resolution in accordance with the Centre's Rules and applicable laws in a manner that is fair, confidential, efficient, and expeditious, thereby safeguarding the lawful rights and interests of the disputing parties and maintaining the reputation of the Centre.
Any amendment to the Centre's scope of activities or objectives shall comply with the applicable laws and shall obtain the prior written approval of the Minister of Justice before being officially implemented.
Functions and Duties of VIFCA
To organize and administer the resolution of disputes through institutional arbitration and to provide administrative support for ad hoc arbitration. The Centre shall not directly adjudicate disputes. Jurisdiction to resolve disputes shall rest with the Arbitral Tribunal constituted in accordance with the parties' agreement, applicable laws, and the relevant arbitration rules.
To organize and administer the resolution of disputes through commercial mediation based on the parties' agreement, applicable laws, and the VIFCA Mediation Rules.
To provide other services relating to arbitration and commercial mediation, including but not limited to the appointment of arbitrators, commercial mediators, and experts, as well as administrative support for institutional or ad hoc arbitration proceedings where the parties agree not to apply the VIFCA Arbitration Rules or the VIFCA Mediation Rules.
To provide administrative, managerial, and other support to the Centre's arbitrators and commercial mediators during arbitration and mediation proceedings, ensuring that disputes are accepted and resolved promptly, confidentially, and with due respect for the parties' autonomy, in accordance with the VIFCA Arbitration Rules and/or the VIFCA Mediation Rules and the applicable laws.
To organize conferences, seminars, training programmes, professional development activities, research, promotional activities, and other lawful services for the purpose of advancing the development of the Centre.
To research, develop, and operate online dispute resolution systems by maximizing the use of the Internet, big data, artificial intelligence, and other information technologies in order to provide efficient and convenient dispute resolution services to the parties.
To submit the lists of arbitrators, commercial mediators, and Members of the Centre, and/or decisions on the appointment or reappointment of Members, to the Ministry of Justice for publication in accordance with the law.
To submit periodic and ad hoc reports on the Centre's activities to the Department of Justice and the Ministry of Justice in accordance with the applicable laws.
To perform other functions and duties as prescribed by law.
